FRCP 37(f): What the Heck is Good Faith?
One of the significant amendments to the Federal Rules of Civil Procedure (the "FRCP Amendments") creates a new "Safe Harbor" provision which, generally speaking, will preclude a court from imposing sanctions against a party for the destruction of electronically stored information if such destruction occurred pursuant to the "routine" operation of an electronic storage system.

The caveat of good faith states that in order to claim protection under the Safe Harbor provision, the responding party must not only demonstrate that the destruction occurred in connection with the "routine" operation of an electronic information system, but it must also demonstrate that such "operation" occurred in "good faith."

This whitepaper provides some practical suggestions on measures corporations should implement in order to establish good faith under the proposed framework.

RightFax Exchange 2007 Connector
Currently, the RightFax Exchange 2007 Connector is being tested in production environments. RightFax 9.3 must be installed to take advantage of the connector, upon release. There is no official release date of the connector yet, but it will be included with RightFax 9.3 Feature Pack 2. In preparing for the release of the Connector, keep in mind that it can only be installed on Exchange 2007 servers that are configured for the Hub Transport Role. Also, with a change in file structure, no Active Directory interaction or Schema Updates will be required.

If there currently is a need to use an Exchange 2007 server to route faxes through a RightFax server, you can use the RightFax SMTP gateway. The SMTP services and a POP3 mailbox will need to be available on the Exchange server. If you have further questions, please email us at support@instantinfo.com.

Upgrading to RightFax 9.3 on a new server with existing Brooktrout Fax Board
If you are planning on upgrading to RightFax 9.3 on a new server using the existing Brooktrout Fax Board from the old server, RightFax 9.3 must be installed in certain steps. Install the RightFax 9.3 Software and Hardware drivers, but do not install Feature Pack 1B or any HotFix until the board is placed in the server and added in the DocTransport or Boardserver module. If the Feature Pack is installed before the board is added in the DocTransport or Boardserver module, Inbound faxing will not work properly. Once the board has been installed in the server and added to the DocTransport or Boardserver module, Feature Pack 1B and any HotFix can be installed.
